a) Data controller: We hereby inform you that any personal data you provide while using the order service will be processed by ESPORTS DE NEU SOLDEU-INCLES, S.A. (hereinafter, ENSISA), in its capacity as the data controller. 2.- File registered with the Andorran Data Protection Agency in accordance with Andorran legislation
In accordance with the Andorran Qualified Act 15/2003, of 18 December, on Personal Data Protection (hereinafter, ‘QAPD’), and its implementing regulations, we hereby inform you that any personal data you provide to ENSISA will be included in a file held by the company and duly registered with the Andorran Data Protection Agency.
3.- Processing purpose, lawful basis for processing and personal data retention period
3.1.- Processing purpose
ENSISA will collect and process your personal data with the purpose of handling any complaints or incidents and requests to exercise your data rights relating to the acquisition of the ordering service. In accordance with article 11 of the EU General Data Protection Regulation (hereinafter, ‘GDPR’), if ENSISA can demonstrate that it cannot identify you, it is not obliged to maintain, acquire or process additional information in order to do so. Nonetheless, in accordance with point 2 of the same article, if it is possible (and it is, in this case), ENSISA is obliged to inform you accordingly. In these cases, articles 15 to 20 do not apply, unless, for the purpose of exercising your rights under these articles, you provide additional information enabling ENSISA to identify you.
3.2.- Lawful basis for processing
The data processing is necessary for the execution of the corresponding contract, through which you acquire ENSISA’s services or products.
3.3.- Personal data retention period
In general, your personal data will be retained for this purpose for 5 years and, if applicable, for the duration of any litigation and until all legal remedies are exhausted.
4.- Recipient categories, including service providers, and transfers to other countries or international organisations (international transfers)
4.1.- If necessary, to fulfil the aforementioned purpose, your personal data may be passed on to the following categories of recipients:
- ENSISA service providers that need to process your personal data for reasons relating to the data processing purpose. They will do so in accordance with ENSISA’s instructions, this additional information and any appropriate security and confidentiality measures established by the company
- Third parties with no relation to ENSISA, if, in good faith, ENSISA identifies the need to carry out the transfer in order to: (1) comply with any applicable and enforceable law, regulation, legal procedure or governmental requirement; (2) comply with the terms and conditions of the acquired product and/or services, including the investigation of possible violations, and/or (3) detect, prevent or otherwise deal with fraud, security breaches or technical problems
- Competent public administrations, in the cases provided for by law and for the purposes defined by law
4.2.- ENSISA does not carry out international personal data transfers, pursuant to the provisions of the QAPD and the GDPR.
5.- Your personal data rights
In accordance with article 11 of the GDPR, the data ENSISA processes for the purpose of dealing with your orders is not subject to the rights to access, rectification, erasure, restriction of processing and data portability, unless, for the purposes of exercising your rights under articles 15 to 20, you provide additional information enabling ENSISA to identify you.
- In accordance with the QAPD, ENSISA hereby informs you that you may exercise your rights to access, rectification or erasure of your personal data, and if you are located in the European Union, as well as these rights, you may also exercise your rights to restriction of processing and data portability and the right to object to the processing of your data.
You may exercise these rights by sending a written, signed notification to the email address dpd@soldeu.ad, to which you must attach a copy of your passport or other national ID document, the last four digits of the card you used to make payment and the date and approximate time of your order.
Furthermore, you may seek additional information about your rights and, if you so wish, file a complaint, by contacting a data protection control authority. Should you wish to do so in Andorra, we hereby inform you that the contact details for the Andorran Data Protection Agency (APDA) are displayed on www.apda.ad.
6.- Security
ENSISA guarantees that the processing of your personal data will be subject to strict professional confidentiality, and that it has implemented all the technical and organisational measures needed to guarantee the security of your personal data and prevent its alteration, misuse, loss, theft, unauthorised processing and unauthorised access.

This additional information is subject to periodic modifications, in accordance with the applicable law at any given time.
